IMPORTANT: The information and Counseling Services provided by Intrinsic Beginnings are for educational, informational, and supportive purposes only. They are NOT intended to be a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider (such as a doctor, midwife, or pediatrician).

5. User Conduct and Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable national, regional, or international law or regulation.

• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.

Fees for Counseling Services will be communicated to you separately during the consultation or agreement process. The Service (website) itself is generally free to access for informational purposes. Payment terms, methods, and cancellation policies for paid services will be detailed in the separate service agreement.

9. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease.

 

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Intrinsic Beginnings, nor its owner (Nicole Holliday), employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• (i) your access to or use of or inability to access or use the Service;

• (ii) any conduct or content of any third party on the Service;

• (iii) any content obtained from the Service; and

• (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Notwithstanding the above, nothing in these Terms shall exclude or limit our liability for damage arising from intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, limb, or health (Verletzung von Leben, Körper oder Gesundheit), or for liability under the German Product Liability Act (Produkthaftungsgesetz), or other statutory mandatory liabilities that cannot be excluded or limited by law.

 

11. Indemnification

You agree to defend, indemnify, and hold harmless Intrinsic Beginnings and its owner (Nicole Holliday), employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service; b) your breach of these Terms; or c) your violation of any law or the rights of a third party.

 

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms and the use of the Service shall be Bad Nauheim, Germany, provided you are a merchant (Kaufmann), a legal entity under public law (juristische Person des öffentlichen Rechts), or a special fund under public law (öffentlich-rechtliches Sondervermögen). If you are a consumer (Verbraucher), the statutory provisions regarding jurisdiction shall apply.

 

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

 

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

 

15. Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Intrinsic Beginnings to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

 

16. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Intrinsic Beginnings regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
